Borisboy-Poppers specializes in the sale of clothing, Poppers and other LGBT + products.
2. Reservation and payment
The customer has the option of reserving a product.
Borisboy-Poppers reserves the right to refuse orders and reservations in the following cases:
in the event of serious suspicion of bad faith or intent to defraud;
in the event of repeated abuse of the right of withdrawal;
in the event of a suspicion of repeated abuse (of law) or fraud on the part of a client;
in the event of communication of erroneous, suspicious or incorrect data;
if Borisboy-Poppers finds that a person repeatedly provides fictitious data;
if Borisboy-Poppers finds an abnormal order quantity - possibly in several purchase orders - which exceeds strictly personal use;
if it can be presumed that orders have been made for the purpose of resale;
in case of force majeure.
The customer has the option of purchasing a product and having it delivered to their home. At this point, the purchase / sale contract is concluded. The customer will be informed by email when the product is delivered to his home.
3. Delivery or collection of an order
The customer's order is delivered - after receipt of payment - to an address chosen by the customer. The customer has a right of revocation for 14 calendar days (see point 10).
In the event that the delivery of the ordered goods is postponed, Borisboy-Poppers reserves the right to modify the sale price. This sale price will be modified in the event that the purchase price, taxes, duties or levies that Borisboy-Poppers must pay have been modified between the date of acceptance of the order and the expected delivery date.
4. Price
Unless otherwise agreed in the contract, prices are inclusive of VAT, Recupel and all other taxes included. Additional costs for delivery, reservation, or other mandatory administrative charges are listed separately.
All prices are in Euro / €.
Additional services (delivery, installation, financing, etc.) are therefore not included and the products will be delivered against payment of any additional costs.
Items purchased from the Borisboy-Poppers online store are paid for by the customer before delivery. No delivery or reservation will be made until the full purchase amount has been paid. The price, including any delivery costs, must therefore be paid in full before delivery. A "distance selling" contract will not be drawn up until a purchase order has been delivered to the consumer or has been emailed to the consumer at the email address provided by the customer.
Promotions and special offers are only applicable within the limits of available stock. Borisboy-Poppers cannot be held responsible for any consequences related to typing errors in prices or in articles, defects in images or in the meantime changes made to designs.
Borisboy-Poppers reserves the right to apply the correct price or to unilaterally cancel an order if it appears that the price indicated and / or the description of the product (s) as well as any associated options are incorrectly indicated on the website following a technical failure or human error.
The customer can choose between different online payment methods.
5. Delivery
The delivery method is indicated in a confirmation sent by e-mail to the customer. The products ordered and reserved are delivered according to available stocks.
Deliveries are made by various carrier partners selected by Borisboy-Poppers depending on the size of the products in the order and the services chosen by the customer.
Partial deliveries are not possible. All the products appearing on the same order are delivered together.
Orders are delivered to the address indicated by the customer when placing his order. In some cases, the delivery driver may need to ask for an identity document upon delivery. Any order reported as delivered by the carrier cannot be the subject of a complaint.
Each visible defect of the product must be mentioned on the copy of the delivery note and it must be returned to Borisboy-Poppers (info@Borisboy-Poppers.com) within two calendar days of delivery.
If the order contains only small and medium-sized items, and in the event of the customer's absence during delivery, the delivery person will leave a message in the latter's letterbox, on which will be indicated the most suitable post office. near where it will be possible to collect the item within 14 calendar days upon presentation of an identity document.
For orders containing one or more bulky products, as well as for orders requiring installation, our specialized delivery partner will contact the customer to arrange a delivery date. In case of representation due to the absence of the customer, Borisboy-Poppers reserves the right to charge the additional costs to the customer.
Borisboy-Poppers cannot be held responsible for the loss or damage of the product in the event of delivery by our partner to a location chosen by the customer other than his home address, for example, to the customer's neighbor. or at a private address near the customer.
The customer is responsible for the place of delivery chosen according to the conditions of the delivery partner.
6. Delivery time
Unless the parties provide otherwise regarding the time of delivery, for example in the case of a pre-order, order or when the product is not in stock, Borisboy-Poppers delivers the goods no later than 30 days after the conclusion of the contract.
7. Transfer of ownership and risks
The right of ownership of the delivered articles is transferred from Borisboy-Poppers to the customer only after the withdrawal or delivery of the articles and after full payment of the order.
As long as payment of the sale price has not been made, the customer is prohibited from pledging the articles or offering them or even using them as security in any way whatsoever. The customer is expressly forbidden to make changes to these articles, to make them real property by incorporation or by destination, to sell them or to dispose of them in any way whatsoever.
As long as Borisboy-Poppers owns the property rights to the delivered goods, in accordance with the provisions of this article, the customer will remain responsible for maintaining these goods in good condition. During this period, only the customer can be held responsible for the loss or possible damage of the goods. The customer undertakes to insure the goods against any risk. The customer also undertakes to store the goods in such a way that they cannot be confused with other goods and that they can at all times be recognized as being the property of Borisboy-Poppers. Each payment made by the customer will first be deducted from the unpaid amounts due for goods that have been altered or sold by the customer in violation of this section.
8. Right of revocation
The customer has the right to communicate to Borisboy-Poppers that he renounces the purchase, without payment of a fine and without giving any reason within 14 calendar days from the day following the delivery of the article.
The right of revocation does not apply to legal persons or to products purchased for professional purposes by a natural person. To exercise the right of revocation, you must inform us, by an unequivocal statement, of your decision to revoke the contract. You can use the standard revocation form for this purpose. With regard to the exercise of the right of revocation, the burden of proof lies with the customer. The customer is responsible for any loss in value of the products resulting from handling beyond what is necessary to determine their nature, characteristics and operation.
The customer is asked, when returning the products, to include the accessories, instructions for use, the invoice as well as the proof of purchase. The products which will not be returned to Borisboy-Poppers in this state, will remain at the disposal of the customer.
In case of exercise of the right of revocation, the customer will return the products to Borisboy-Poppers by all means and at his own risk and expense. Shipments "postage paid by the recipient" and "against reimbursement" will be refused.
In order for the goods to be returned if they are not broken, the following conditions must be met.
1. Goods must be unused and clean
2. The goods must be in their original condition and packaging.
3. Goods that are not heat sealed in the box are not refundable or exchangeable.
4. Items supplied in sealed packaging that have been opened are not refundable or exchangeable.
5. Goods must be received within 14 days of receipt of order by your customer.
If we suspect that the goods have been used or that any of the above conditions are not met, we reserve the right to return the goods.
Otherwise, if you want, we will exchange the item.
Please Note: Goods will only be accepted for return if dispatched within 14 days of delivery, unless we have notified you otherwise. The object is your responsibility until it reaches us. Therefore, for your own protection, we recommend that you send the package using a delivery service that insures you for the value of the goods. You are responsible for the cost of returning the item to us.
Delivery charges are only refundable if the products are defective and a refund is issued.
The customer, or a third party other than the carrier and designated by the consumer, must exercise his right of revocation within 14 calendar days from the day following delivery of the product or takes physical possession of the product and the customer returns the products, within 14 calendar days from the exercise of the right of revocation or notification. You are asked to return the products in their original packaging with all accessories delivered and in their original condition. Borisboy-Poppers reserves the right to consider, in the event that the goods are damaged, incomplete or have been installed, the customer as responsible for the loss of value which would be the consequence of the use of the goods other than that necessary to establish the nature, characteristics and proper functioning of the goods, and an amount will therefore be retained during reimbursement in accordance with the damage observed.
To proceed with the refund, Borisboy-Poppers reserves the right to wait for the product (s) to be received or for the customer to prove that all the products have been returned. The return is the responsibility of the customer. No refund is made in cash. Borisboy-Poppers reserves the right at any time to deduct from the purchase price to be refunded the amount of depreciation for which the customer is responsible.
If the customer has expressly requested a delivery method other than the cheapest standard delivery offered by Borisboy-Poppers, the additional delivery costs will not be reimbursed.

9. The right to dissolution
In the event of the insolvency of the customer or in the event of unpaid debts, even under previous contracts between the customer and Borisboy-Poppers, Borisboy-Poppers is entitled to suspend the performance of its obligations until full reimbursement by the customer from any unpaid debt owed to Borisboy-Poppers In the event that no payment is made by a customer within 7 calendar days of the due date of any invoice, Borisboy-Poppers is entitled to consider the contract as dissolved, automatically and without prior notice, without prejudice to its right to demand interest and / or compensation.
10. Internet risks
The customer is aware of the restrictions and risks associated with the use of the internet or any other means by which the website is currently or will be made available in the future. The customer is also aware of the risks of storing and transmitting information digitally or electronically. The customer accepts that Borisboy-Poppers cannot be held responsible for any damage caused by the use of the Borisboy-Poppers website or the internet, as a result of the aforementioned risks. The customer accepts that electronic communications and backups can serve as proof.
11. General provisions - competent courts
11.1. If one of the articles of these general conditions was invalid or null or was declared null by a competent court, this would not affect the validity of the other articles of these general conditions which would remain fully applicable. Any dispute concerning the existence, execution and / or interpretation of these general conditions and all contracts concluded between Borisboy-Poppers and its customers are subject to the exclusive power of the Court of Lille.
11.3. We are a French company that markets legal goods in France. The law varies from country to country. The legality of importing / receiving something in your own country of residence depends on the customs laws and regulations of your country. Borisboy-Poppers falls under French law, and is therefore not responsible for items that are opened, lost, retained or seized by the postal or customs authorities in your country. As a consumer, you should obey and know the laws and regulations in your own country. The customer is responsible for any legal problem arising from the customs of his country. Under no circumstances will Borisboy-Poppers be responsible for the sale and delivery of prohibited goods in the customer's country.
When we ship goods outside the EC, the package goes through customs in the country of destination. Borisboy-Poppers ensures correct exportation but has no connection with your national customs procedures. All costs involved (import tax, local duties, VAT) will be the responsibility of the customer.
